These Terms govern your use of the members-only training community and related applications (the "Service") operated by THE CLUB ATHLETIC SOCIETY (the "Club").
1. Membership
Membership is by selection. The Club decides on admission based on your application and interview. Membership is personal and may not be lent or transferred to any third party.
2. Fees and payment
- Membership fees are paid monthly in advance. The first payment is taken at sign-up and recurs automatically on the same day each month.
- Fees and plan contents are as published on the pricing section of our website.
- Payment is made by credit card or another method designated by the Club.
- Plan changes take effect from the following billing month.
3. Cancellation
- You may cancel at any time by notifying us before the day preceding your next renewal date.
- After cancellation you may continue to use the Service until the end of the current month. We do not pro-rate or refund the current month.
- If the Club cancels a session, we will offer an alternative date or a partial refund of that month's fee.
4. Booking and cancellation of sessions
Official sessions are booked through the app. When a session is full you join the waiting list and are promoted automatically as places open. Repeated no-shows may result in booking restrictions. Cancellation terms for one-off sessions and events are those shown on the relevant booking screen.
5. Member-hosted activities (ACTIVITIES)
- Members may host and join self-organised activities through the app. These are not official, Club-coached sessions; they are the members' own activities.
- Hosting members must not provide coaching, charge participation fees, solicit business, or present the activity as an official Club session.
- The Club may restrict which categories of activity can be hosted. Higher-risk disciplines (mountain sports, skiing, swimming and similar) are limited to official events.
- Disputes between members are to be resolved between the parties concerned; except where attributable to the Club, the Club bears no responsibility for them.
6. Health and personal responsibility
Members complete a health declaration (PAR-Q) on joining and when otherwise required. If you have any concern about your condition, please consult a physician before taking part. The Club may decide on your participation based on the information declared.
7. Insurance
The Club enrols every member in sports accident insurance, included in the membership fee. Cover and conditions are governed by the policy terms. For higher-risk one-off events, additional insurance may be required as a condition of entry.
8. Prohibited conduct
- Nuisance, harassment or discriminatory conduct towards members, coaches, staff or venue personnel
- Using the Service for sales, solicitation, religious or political campaigning, or pyramid schemes
- Disclosing another member's records or personal information without their permission
- Breaching venue rules, damaging equipment, or disregarding safety instructions
- Any conduct contrary to law or public order
9. Records, photography and video
Training records are private by default and visible only to members you have authorised. Use of photographs and video taken during sessions for promotional purposes is subject to a separate consent given at sign-up. Declining does not affect your membership.
10. Suspension and expulsion
If a member breaches these Terms, the Club may restrict bookings, suspend membership or expel the member without prior notice. Fees already paid are not refunded in the event of expulsion.
11. Limitation of liability
- The Club compensates members for loss arising from the provision of the Service where such loss is attributable to the Club.
- Where the Club is only slightly negligent, compensation is capped at the total membership fees paid by the member during the twelve months preceding the loss. This cap does not apply where the Club has acted with intent or gross negligence, nor to loss of life or personal injury.
- Beyond the remedies in clause 3, the Club bears no liability for sessions cancelled or changed due to weather, disaster, venue circumstances or other unavoidable causes.
12. Changes to these Terms
The Club may amend these Terms as necessary. Where an amendment is disadvantageous to members, we will give notice through the app or by email a reasonable period before it takes effect.
13. Governing law and jurisdiction
These Terms are governed by Japanese law. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any dispute relating to the Service.
